Terms of Service

These terms govern your use of TCG Invoice, provided by Thaku Huni, trading as The Tech Company Group (ABN 60 997 507 184). By creating an account you agree to them. If you are agreeing on behalf of a business, you confirm you are authorised to bind that business.

What the service does

TCG Invoice lets you create invoices, send them to your clients by SMS or email, and accept payment for them. We provide the software. We are not a party to the underlying work or agreement between you and your client, we do not guarantee that your clients will pay, and we do not provide accounting, tax or legal advice.

Your account

  • You must give accurate details when you sign up, and keep them current.
  • You are responsible for activity under your account. Sign-in links and codes we send are the keys to it — treat them as you would a password.
  • Accounts are for business use, and you must be at least 18 to open one.
  • Tell us promptly if you believe someone else has accessed your account.

Plans and billing

The free plan allows a limited number of invoice sends each calendar month. Paid plans remove that limit and add features described on our pricing page at the time you subscribe.

  • Paid subscriptions are billed monthly in advance in Australian dollars through Stripe, and renew automatically until cancelled.
  • Where a free trial is offered, we will begin charging at the end of the trial unless you cancel before it ends.
  • You can cancel at any time from Settings. Cancellation takes effect at the end of the period you have already paid for, and you keep access until then.
  • We do not give refunds for partial months, except where required by the Australian Consumer Law.
  • We may change prices, but not for a period you have already paid. We will give at least 30 days' notice by email before a change affects you.

Payments from your clients

Card payments are processed by Stripe, and your use of that facility is also subject to Stripe's own agreement, which you accept when you connect your account. Settlement timing, payout schedules, holds and chargebacks are determined by Stripe, not by us.

If you display bank details on your invoices, payments made that way happen entirely between you and your client. We have no visibility of them and cannot confirm, trace or recover them.

Your content and your clients' information

Your invoices, client records and business details remain yours. You grant us permission to store, process and transmit them only as needed to run the service — for example, to deliver an invoice to the client you addressed it to.

You are responsible for what you put into the service, including having a proper basis to provide your clients' contact details to us, and for making sure the invoices you send are accurate and lawful. How we handle personal information is set out in our Privacy Policy.

Acceptable use

You must not use TCG Invoice to:

  • Send invoices for goods or services that were not genuinely provided or agreed.
  • Send unsolicited marketing messages, or anything breaching the Spam Act 2003 (Cth).
  • Harass, threaten or mislead recipients.
  • Break any law, or infringe anyone's rights.
  • Attempt to gain unauthorised access to the service, other accounts, or the systems behind them, or to interfere with their operation.

Messaging costs us money per send and abuse damages our ability to deliver everyone's invoices. We may suspend an account we reasonably believe is being used this way, and where practical we will tell you why and give you a chance to respond first.

Availability

We aim to keep the service running and available, but we do not promise it will be uninterrupted or error-free. We depend on third parties — hosting, payments, SMS and email providers — and outages in their systems will affect ours. We may take the service down for maintenance, and will give notice where we reasonably can.

Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Where our liability can be limited, we limit it to resupplying the service or paying the cost of having it resupplied.

Liability

Subject to the section above, and to the maximum extent permitted by law: we are not liable for indirect or consequential loss, loss of profits, loss of business, or loss or corruption of data; and our total liability arising out of or in connection with the service in any 12-month period is limited to the amount you paid us for the service in that period.

In particular, we are not responsible for invoices your clients do not pay, for amounts entered incorrectly, or for messages a carrier or mail provider fails to deliver.

Ending your account

You can stop using the service and close your account at any time. We may suspend or close an account that breaches these terms, or where we stop offering the service — in which case we will give reasonable notice and refund any period you have paid for in advance.

You can export or copy your invoice records before you close your account. After closure we keep records for the periods described in the Privacy Policy, then delete them.

Changes to these terms

We may update these terms. If a change materially affects your rights, we will give at least 30 days' notice by email or in the app. Continuing to use the service after a change takes effect means you accept the updated terms.

Governing law

These terms are governed by the laws of New South Wales, Australia, and you and we submit to the courts of that state.
